Terms of Use

These Terms of Use ("Terms") govern access to and use of MetaMind Social at https://smm.metamindigital.com.np (the "Service"), operated by MetaMind Digital Pvt. Ltd. ("we", "us", "our"). By using the Service you agree to these Terms. If you use the Service on behalf of an organization, you agree to them on its behalf.

1. The Service

The Service is a social media management platform that lets authorized users connect social media accounts, create and schedule content, publish it, respond to comments and messages, and view analytics. We provide the Service to our clients and their team members as part of our social media management services.

2. Accounts

• Accounts are created by us or by an administrator of your organization. You must provide accurate information and keep it up to date.
• You are responsible for keeping your password confidential and for all activity under your account. Tell us immediately if you suspect unauthorized access.

3. Connected social media accounts

• You may only connect social media accounts, Pages or profiles that you own or are authorized to manage.
• By connecting an account you authorize us to access it and act on it through the platform's official API, within the permissions you grant, to provide the Service.
• Your use of each platform remains subject to that platform's own terms and policies, including the Meta Terms of Service, Meta Platform Terms, and the terms of LinkedIn, X and TikTok. You must comply with them.
• You can disconnect an account at any time from the Service or from the platform's settings.

4. Your content

You keep all rights to the content you upload, create or publish through the Service ("Your Content"). You grant us a limited license to host, store, process and transmit Your Content only as needed to provide the Service. You are responsible for Your Content and confirm that you have the rights needed to publish it.

5. Acceptable use

You agree not to use the Service to:

• publish content that is unlawful, infringing, defamatory, harassing, hateful, deceptive or sexually explicit;
• send spam or unsolicited bulk messages, or artificially inflate engagement;
• violate the terms, policies or rate limits of any connected social media platform;
• access accounts or data you are not authorized to access, or interfere with the security or operation of the Service;
• reverse engineer, resell or sublicense the Service without our written permission.

We may suspend or remove content or access that violates these Terms.

6. AI-generated content

AI-assisted features may generate text or images that are inaccurate or unsuitable. Review all AI-generated content before publishing; you are responsible for anything you publish.

7. Privacy

Our Privacy Policy explains how we handle personal information. Our Data Deletion Instructions explain how to have your data removed.

8. Fees

Fees for our social media management services are set out in your separate agreement or invoice with us.

9. Availability and changes

We work to keep the Service available but do not guarantee uninterrupted operation. Social media platforms may change or restrict their APIs at any time, which can affect features of the Service. We may modify, suspend or discontinue features with reasonable notice where practical.

10. Termination

You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms or if your service agreement with us ends. On termination, connected accounts are disconnected and data is handled as described in our Privacy Policy.

11. Disclaimers

The Service is provided "as is" and "as available". To the extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We are not responsible for the actions, availability or policies of third-party platforms.

12. Limitation of liability

To the extent permitted by law, we will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill. Our total liability for any claim relating to the Service is limited to the amount you paid us for the Service in the three months before the claim arose.

13. Governing law

These Terms are governed by the laws of Nepal. Disputes will be subject to the exclusive jurisdiction of the courts of Nepal.

14. Changes to these Terms

We may update these Terms from time to time. We will post the updated version on this page and change the effective date above. Continued use of the Service after changes take effect means you accept the updated Terms.
